Terms of Service
Last updated: May 20, 2026
These Terms of Service (the "Terms") form a binding agreement between you and Wholesum ("we", "us", or "Wholesum") governing your use of the Wholesum mobile app, website, and related services (the "Service"). By creating an account or using the Service you agree to these Terms. If you don't agree, please don't use the Service.
1. Eligibility
You must be at least 18 years old to use the Service. In some jurisdictions the minimum age is higher; if you live somewhere with a higher minimum, that age governs. By using the Service you represent that you meet these requirements.
2. Your account
- You're responsible for keeping your password confidential and for everything that happens under your account.
- You agree to provide accurate information (especially the age / height / weight inputs that calculate your calorie targets; inaccurate inputs produce inaccurate targets).
- One person per account; don't share credentials.
3. Free tier and Wholesum+
The Service offers a free tier (daily food tracking, calorie logging) and a paid "Wholesum+" subscription (macro tracking, smart goals, history + trends, barcode scanner, recipes, friends, daily diet-style ratio).
- Wholesum+ subscriptions are billed through your App Store account (Apple) or Google Play account (Google), or through our subscription provider on the web. The exact price, billing frequency, and renewal terms shown at purchase apply.
- Subscriptions auto-renew until you cancel. You can cancel in your App Store / Play Store / web account at any time; cancellation takes effect at the end of the current billing period.
- Refunds are handled by your billing provider per their policies. We don't issue separate refunds for the recurring portion.
4. Health disclaimer (read this)
Wholesum is not a medical device and does not provide medical advice. The calorie targets, macro recommendations, and weight-change adjustments produced by the Service are estimates based on the Mifflin-St Jeor equation and your self-reported inputs. They are meant as a starting point for general wellness, not as a treatment plan for any condition.
Always consult a qualified healthcare provider before starting a diet, weight-loss program, or fitness program, especially if you are pregnant, nursing, under 18, over 65, have a history of eating disorders, diabetes, kidney disease, heart disease, or any other medical condition. Stop using the Service and contact a professional if it ever encourages you toward an unsafe weight, calorie intake, or eating pattern.
You are solely responsible for decisions you make based on information from the Service.
5. Your content
- You retain ownership of food logs, weight check-ins, recipes, photos, and other content you create in the Service ("Your Content").
- You grant us a non-exclusive, worldwide, royalty-free license to host, store, and display Your Content as needed to operate the Service for you and the friends you choose to share with.
- You're responsible for what you upload. Don't upload anything illegal, infringing, hateful, harassing, or that encourages eating disorders.
6. Things you must not do
- Reverse-engineer, decompile, or scrape the Service.
- Use the Service to harass, dox, or target other users (including via the friends feature).
- Attempt to access another user's account or data without permission.
- Use the Service to promote pro-eating-disorder content or extreme dieting practices.
- Resell or rent the Service.
7. Third-party services
Some features rely on third parties (USDA FoodData Central for generic food search, Open Food Facts for branded products, Supabase for storage, Sentry for crash reporting, PostHog for analytics, and your platform's billing system). Those services have their own terms; we're not responsible for their availability or accuracy.
8. Termination
We can suspend or terminate your account if you violate these Terms. You can delete your account at any time (email support@wholesum.app or use the in-app deletion flow when shipped). Deletion is permanent.
9. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied (including merchantability, fitness for a particular purpose, and non-infringement). We don't warrant the Service will be uninterrupted, error-free, or that the data is accurate. To the fullest extent permitted by law, we disclaim all warranties.
10. Limitation of liability
To the fullest extent permitted by law, in no event will Wholesum, its affiliates, officers, or employees be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our aggregate liability to you for any claim arising from these Terms or the Service is limited to the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD $50.
11. Indemnification
You agree to indemnify and hold Wholesum harmless from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any third-party right.
12. Governing law and disputes
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in the State of California, United States, and you consent to personal jurisdiction there.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced in the app and via email; continued use of the Service after the effective date constitutes acceptance.
